Please read these Terms and Conditions of Use ("the Terms") carefully. By using Global Maritime Jobs (" the Site") and the on-line recruitment and advertising solutions ("the Services") you ("You") agree to be bound by the Terms governing this Site and the Services. If You do not agree to the Terms then You are not authorised to use the Site and the Services. Your use of the Site and the Services will be deemed acceptance of the Terms.

Global Maritime Jobs ("The Company") may from time to time revise the terms, Jobba therefore advises that You read this page periodically to review the Terms, because any changes will be binding on You. Last changes made on 20-03-2016.

1. Acceptable Web Site Uses

1.1. Jobseeker
1.1.1. Jobseeker agrees that he/she shall only use the Web Site for lawful purposes and seeking employment. Jobseeker may send his/her information directly to any Employer who advertises on or through the Web Site. Alternatively, Jobseeker may send his/her information to the Company through the Web Site in reply to any job advertisement. In such event, Jobseeker's information will also remain active on the Web Site and be stored in the Company's database at his/her own risk unless and until he/she chooses to delete it. Jobseeker acknowledges and agrees that his/her information may be accessed by employer who has subscribed to the services of the Company for the sole purpose of obtaining and assessing the suitability of Jobseekers ("Employer"). The Company also reserves the right to edit any Jobseeker's information as it sees appropriate to achieve the purpose stated herein and to erase any personal data which the Company reasonably believes that such data are inaccurate having regard to the purpose (including any directly related purpose) for which the data are or are to be used.
1.1.2. The Company will not release Jobseeker's personal data to any Employer without his/her permission. Jobseeker also acknowledges and agrees that the Company will release his/her profile (without his/her name, address and other personal identifiable information) to Employer through the use of the Company's search engine or any other means for the sole purpose of obtaining and assessing the suitability of Jobseekers in relation to any job vacancy. However, Jobseeker agrees that the Company and its associated companies may use his/her personal data (without his/her name, address and other personal identifiable information) for marketing purposes which may be directed to either potential employers or Employers, their respective agents or anyone under their employ.
1.1.3. The Company will not be responsible or held liable in any way if any Employer, in breach of the Terms and Conditions, whether in Hong Kong or elsewhere, use the Jobseeker's personal data for any use other than for obtaining potential employees. Jobseeker accepts that personal data given to Employer or other users are given entirely at his/her own risk. Also, the Company reserves the right to terminate any services to any Jobseeker should it become aware of any breach by any Employers and/or Jobseekers.

1.2. Employer
1.2.1. Upon subscription of the service to the Company, Employer will be entitled to use the Web Site to advertise job vacancies and/or create their own profile on the Web Site. Employer will also be entitled to access the Database but agrees that all information obtained shall only be used for the sole purpose of obtaining and assessing the suitability of Jobseekers. Employer acknowledges and agrees that it shall disregard any personal data received from Jobseeker which are irrelevant to obtaining and assessing the suitability of candidates. Employers shall be solely responsible for the contents and materials contained in its advertisement and/or profile.
1.2.2. The Company reserves the right to edit any advertisement or profile as it sees appropriate to achieve the purpose stated herein. The Company shall have the right to terminate any services to any Employer and remove any advertisement posted on the Web Sites at the Company's sole discretion, without any compensation or recourse to the Advertiser in the event that the relevant Advertiser or the contents of the relevant advertisement is or are in breach of any of the provisions herein. The Company also reserves the right to change the service fee or institute new charges or fees, as it deems appropriate. In the event that any Employer fails to pay the service fee or any other fees or charges due to the Company, the Company reserves the right to suspend or terminate the Employer's profile or advertisement, without prejudice to all other rights and remedies.

1.3. Minors
1.3.1. If you are under the age of 18, or you are considered as a minor or not being capable of assuming legal responsibility, you are not allowed to use the Web Site if you might incur any legal obligations or liabilities in doing so. If you wish to view and access the Web Site, you should seek advice from your parents or guardians as to the meaning and consequences of these terms and conditions. The Company presumes that every user of the Web Site is of legal age. The Company is not obliged to verify your age but in the event it is discovered that any user of the Web Site is not of legal age, the Company reserves the right as may be available against such users, or the parents or guardians of such users, including the right to terminate access to the Web Site.

1.4. Prohibited Uses
1.4.1. Jobseeker and Employer agree not to use the Web Site for any of the following purposes which are expressly prohibited:
1.4.2. Jobseeker shall not post any incomplete, false or inaccurate information.
1.4.3. Jobseeker shall not respond to any employment opportunity for any reason other than to apply for the job advertised and Employer shall not respond to any Jobseeker other than in connection with his/her application for a job. Communications soliciting business for any reason is prohibited.
1.4.4. All unsolicited communications of any type to users is strictly prohibited.
1.4.5. All users shall not delete or revise any material posted by any other person or entity.
1.4.6. All users are prohibited from violating or attempting to violate the security of the Web Site including, without limitation, accessing data not intended for them or logging into a server or account which they are not authorised to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorization, attempting to interfere with service to any user, host or network or sending unsolicited e-mail, including promotions and/or advertising of products or services. Violations of system or network security may result in civil and/or criminal liabilities.
1.4.7. All users shall not use the Web Site for transmitting, distributing or storing material in violation of any applicable law or regulation, or in any manner that may infringe the copyright, trademark, trade secrets or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others, or that is libelous, obscene, threatening, abusive or hateful.

2. Licence

2.1. You are permitted to print and download extracts from this Web Site for your own use on the following basis:
2.1.1. no documents or related graphics on this Web Site are modified in any way;
2.1.2. no graphics on this Web Site are used separately from accompanying text; and
2.2. The copyright and other intellectual property rights in all material on this Web Site (including without limitation photographs and graphical images) are owned by the Company or its licensors. For the purposes of this legal notice, any use of extracts from this Web Site other than in accordance with the paragraph above for any purpose is prohibited. If you breach any of the terms in this legal notice, your permission to use this Web Site automatically terminates and you must immediately destroy any downloaded or printed extracts from this Web Site.
2.3. No part of this Web Site may be reproduced or stored in any other Web Site or included in any public or private electronic retrieval system or service without the Company’s prior written permission.

If you decide to access any of the third party websites linked to this Web Site, you do so entirely at your own risk.
3.2. If you would like to link to this Web Site, you may only do so on the basis that you link to, but do not replicate, the home page of this Web Site, and subject to the following conditions:

3.10.The Company expressly reserves the right to revoke the right granted in paragraph above for breach of these terms and to take any action it deems appropriate.
3.11.You shall fully indemnify the Company for any loss or damage suffered by the Company or any of its group companies for breach of paragraph.

4. Disclaimer

4.1. The company, its officers, directors, employees or agents shall not be liable in any event for any losses or damages suffered by any users whatsoever directly or indirectly arising or resulting from their use or inability to use the web site and its contents.
4.2. While the Company endeavours to ensure that the information on this Web Site is correct, the Company does not warrant the accuracy and completeness of the material on this Web Site.
